Developer Fee Payment Process:
Step 1: Visit the City
Apply to the respective city and obtain an authorized letter specifying the permitted square footage for your project.
Step 2: Visit the District
Bring the authorized letter to the District. Pay the assessed fee (cash, check, or money order only – debit and credit cards are not accepted) and obtain a Certificate of Compliance. The date of your payment determines the assessed rate. Please contact the District to verify the current rates.
Step 3: Return to the City
Return to the city with your Certificate of Compliance to further process your building permit request.
Background
All new residential, commercial, and industrial construction and/or an addition of covered or enclosable space are subject to the collection of developer fees. According to the law, this fee is determined by the square footage of assessable space.
Assessable space is all square footage within the perimeter of a structure. Exclusions include parking structures, carports, walkways, garages, overhangs, patios, or accessory structures (accessory dwelling units are not exempt).

Additional Information
Certain development projects are exempt from school fees. The list below provides a guide for these exemptions, though they are subject to change.
Residential Additions Less than 500 Square Feet
Education Code Section 17620(a)(1)(C)(i) permits school districts to charge Level I Fees on residential additions only if the resulting increase in assessable space exceeds 500 square feet. Additions less than 500 square feet are exempt.
Accessory Dwelling Units (ADUs)
ADUs less than 500 square feet are not subject to school impact fees. ADUs that are 500 square feet or more are subject to school impact fees.
Senior Citizen HousingGovernment Code Sections 65995.1 and 65995.2 provide that school districts may only charge the commercial/industrial fee for qualified senior citizen housing. If converted to another use, the regular residential fee may apply (minus any fees previously paid). Four types of housing qualify:- Senior citizen housing development projects (Civil Code Section 51.3, age 55+ with other restrictions)
- Residential care facility for the elderly (Health and Safety Code Section 1569.2(k), age 60+ with restrictions)
- Multilevel facility for the elderly (Government Code Section 15432(d)(9), age 62+ with restrictions)
- Mobile home development for older persons (Federal Fair Housing Amendments Act of 1988, typically age 55 or 62+)
Residences not meeting these standards are charged the regular residential fee. Proof of qualification (e.g., CC&Rs) must be provided. Churches and Religious Organizations
Government Code Section 65995(d) exempts any facility used exclusively for religious purposes and exempt from property taxation under California law from school fees.
Private Full-time Day School
Government Code Section 65995(d) exempts facilities used exclusively as a private full-time day school (Education Code Section 48222). Districts should request a copy of the required affidavit (Education Code Section 33190).
Government Agencies
Government Code Section 65995(d) exempts facilities owned and occupied by federal, state, or local government agencies from school fees.
Construction for Handicapped Accessibility
Education Code Section 17620 (a)(1)(C)(ii) and Revenue and Taxation Code Section 74.3(a) exempt construction to make a structure more accessible for a disabled person from school fees. A signed physician statement specifying the disability and required improvements is needed for this exclusion.
Reconstruction of a Structure Destroyed in Fire
Education Code Section 17626 exempts reconstruction of structures damaged or destroyed by disaster from school fees, unless the new structure exceeds the original square footage.
Greenhouse Space
Education Code Section 17622 exempts greenhouse or space enclosed for agricultural purposes from school fees unless the board makes specific findings.
Appeals Process for Protests by DevelopersThe Superintendent or designee establishes an appeals process for developer fee protests (Education Code 17621).Developers protesting a fee must (Government Code 66020):
- Tender payment in full or provide evidence of payment arrangements or performance of conditions.
- Serve written notice to the Board, including:
- a. Statement that payment is (or will be) made under protest or that conditions have been satisfied under protest
- b. Statement of factual elements of the dispute and the legal theory for the protest
- File the protest at approval/conditional approval or within 90 days after the fee is imposed.
At the time of imposition, the District must notify the applicant of the 90-day protest period. Developers may file an action to contest the fee within 180 days of notice.
